3M Company is a multinational conglomerate based out of Maplewood, MN. Their primary operating areas are in the fields of industry, health care, general consumer goods and worker safety (health and safety products for the workplace).
Claims have been made against 3M Company that veterans and active duty military personnel have come to experience hearing damage due to the use of defective 3M Combat Arms Earplugs.
The specific type under question in this litigation are the Version 2 — CAEv2 and they were in use by military personnel between 2003 and 2015.
These ear plugs were developed under a partnership agreement between 3M and the US Military and subsequently manufactured by 3M Company and Aearo Technologies, Inc. They were developed to block out high SPL levels produced by blasts and noises commonly occurring during live combat and on-base testing/training exercises.
The ear plugs were intended to prevent high sound pressure levels from reaching the inner ear yet at the same time allow military personnel to hear close proximity verbal commands.
The claim is that 3M were aware that its ear plugs were faulty, yet they failed to notify its customer, the U.S. Government.
3M have countered this claim by saying that “The company worked in close coordination with the U.S. military on the CAEv2 product, and its design reflected the direction and feedback of individuals acting on the military’s behalf. These faulty 3M Combat Arms Earplugs may be responsible for partial or complete hearing loss in members of the military and/or may have caused serious ear conditions such as tinnitus.
