In marketing Vaping products many companies resorted to making unsubstantiated claims about their health benefits versus conventional tobacco products and the buying public were deceived into embracing Vape products from companies like JUUL and placing them into daily use.
In addition to erroneous and unsubstantiated health claims, Vaping products were touted as nicotine cessation aids for people with a history of smoking conventional cigarettes who were looking to quit.
Furthermore, it is alleged that non-users of conventional cigarettes were lured toward the use of Vaping products by deceptive marketing methods and practices, often targeted toward the youth market and children. Introduction of flavored e-Cigarrettes has caused an uptake in Vape product usage reversing a decade long downward trend in tobacco product consumption.
JUUL delivery systems (referred to as ‘pods’) contain a dangerously high amount of nicotine – a typical JUUL pod can contain around the same amount of nicotine as an entire pack of traditional cigarettes.
Also, the nicotine is more readily absorbed by the body and at a higher rate than traditional tobacco products.
Vaping – Legal Actions In North Carolina
The State of North Carolina is now actively suing e-cigarette companies.
In May 2019, The NC State Court filed a lawsuit against JUUL. (This has now expanded to an additional eight vape product companies as of October 9 2019).
The state’s attorney general, Josh Stein, in an announcement on August 27 2019, stated that his office will be filing lawsuits in the North Carolina State Court against eight Vaping Product companies. The companies in question stand accused of “aggressively targeting children and do not require appropriate age verification when selling these dangerous and addictive products.”

Vaping – Cause of Seizures And Other Serious Medical Conditions In Children.
In addition to addiction issues, the CDC are concerned with the risk of potential longer-term cognitive damage in child/teen users of JUUL’s vaping products. The CDC claim that nicotine poisoning and toxicity can cause seizures and convulsions, and other potential dangers to health. In April 2018, the Journal of Pediatrics published a report about the carcinogenic effects of the flavoring chemicals used in vape juice to provide the fruit flavors, which may cause the development of bronchiolitis obliterans, a serious lung disease that is irreversible.

(RALEIGH) Attorney General Josh Stein today announced that he has made significant progress in his lawsuits against e-cigarette companies VapeCo Distribution, Electronic Tobacconist, Electric Lotus, Direct eLiquid, Beard Vape, Tinted Brew, Juice Man, and EonSmoke. The suits, which are brought under the North Carolina Unfair or Deceptive Trade Practices Act, allege that these companies are aggressively targeting children and do not require appropriate age verification when selling these dangerous and addictive products.
“We are only beginning to see the harmful, even deadly health impacts vaping has on young people,” said Attorney General Josh Stein. “But we absolutely know that their tobacco use is on the rise – and that these companies have aggressively marketed their e-cigs to addict a new generation to nicotine. I’m pleased that the courts have shut these companies down while the cases continue. I will do everything in my power to protect our kids from any illegal business practices.”
VapeCo Distribution has agreed not to sell, offer deliver, market, or otherwise provide vapor products in North Carolina. A court agreed to put in place a temporary restraining order to prohibit Electronic Tobacconist from selling its products in North Carolina and there are preliminary injunctions in place for Electric Lotus, Direct eLiquid, and Beard Vape to prohibit them from selling products in North Carolina for the duration of each litigation.
Attorneys for three other companies, Tinted Brew, Juice Man, and Eonsmoke, in addition to VapeCo, have sought to move their cases to federal court – a move that the Department of Justice is fighting to stop.
Attorney General Stein’s lawsuits ask for the courts to shut down sales from these companies in North Carolina. In May of this year, Attorney General Stein filed a similar lawsuit against Juul.”
